Terms of Service

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you (the "Cardholder," "you," or "your") and Hollywood Vault, Inc. ("Hollywood Vault," "we," "us," or "our") governing your application for, issuance of, and use of a Hollywood Vault credit card and any related services.

By applying for, activating, signing, or using a Hollywood Vault credit card, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other agreements incorporated by reference. If you do not agree to these Terms, you must not apply for or use our Services.

To be eligible for a Hollywood Vault credit card, you must meet the following requirements:

• Be at least 18 years of age (19 in Alabama and Nebraska; 21 in Puerto Rico)
• Be a U.S. citizen or legal resident with a valid Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN)
• Have a valid U.S. residential address (PO boxes are not accepted as primary addresses)
• Have a verifiable source of income or assets sufficient to meet creditworthiness standards
• Not be subject to any existing bankruptcy proceedings that would disqualify you under our underwriting criteria
• Meet the minimum credit score and income requirements for your selected card tier

We reserve the right to decline any application at our sole discretion and to request additional information or documentation to verify your identity and eligibility.

When you apply for a Hollywood Vault credit card, you authorize us to:

• Obtain a consumer credit report from one or more consumer reporting agencies (Equifax, Experian, TransUnion)
• Verify your identity, employment, income, and other information provided in your application
• Make a creditworthiness determination based on our underwriting standards
• Set your credit limit, APR, and other account terms based on your credit profile

Approved applicants will receive a Cardholder Agreement and Truth-in-Lending disclosure statement specifying the exact terms of their account. These documents, together with these Terms, constitute the complete agreement between you and Hollywood Vault regarding your credit card account.

Your Hollywood Vault credit card may be used for lawful personal and business purchases anywhere Visa is accepted, subject to the following conditions:

Authorized Use

You are the only person authorized to use your card. You may add authorized users to your account; as the primary cardholder, you are responsible for all transactions made by authorized users. Authorized users do not have the right to make changes to the account or redeem rewards without your permission.

Credit Limit

You agree not to exceed your assigned credit limit. Transactions that exceed your available credit may be declined or, at our discretion, processed with an over-limit fee. We may increase or decrease your credit limit at any time based on your account history, credit profile, and our risk assessment.

Cash Advances

Cash advances are subject to a separate APR, transaction fee, and no grace period. Interest accrues from the date of the cash advance. We may limit the amount of cash advances available to you.

The following fee schedule applies to Hollywood Vault credit cards. Your specific APR and fees will be disclosed in your Cardholder Agreement:

Your APR is variable and based on the Prime Rate as published in The Wall Street Journal, plus a margin determined by your creditworthiness and card tier. We will notify you of any APR changes as required by law.

You will receive a monthly billing statement detailing your transactions, fees, interest charges, and minimum payment due. You agree to the following payment terms:

• Minimum Payment: The greater of $35 or 1% of your balance plus interest and fees, or any amount past due
• Grace Period: No interest is charged on purchases if you pay your full balance by the due date each billing cycle
• Payment Due Date: At least 25 days after the close of each billing cycle
• Late Payments: Subject to a late fee of up to $41 and may result in a penalty APR being applied to your account
• Payment Methods: Online, mobile app, phone, or mail. Payments made before 5:00 PM ET on a business day are credited the same day

We may apply your payments to balances in the order we determine, consistent with applicable law. Typically, payments are applied to the lowest-APR balances first.

Hollywood Vault offers a rewards program that allows you to earn points or cashback on eligible purchases. The following terms apply:

• Points are earned on eligible purchases as specified by your card tier
• Points do not expire as long as your account is open and in good standing
• Points may be redeemed for statement credits, travel, merchandise, gift cards, or transferred to partner loyalty programs
• Cashback rewards are credited to your account balance within 1–2 billing cycles of redemption
• Returns, refunds, or disputed transactions may result in the reversal of previously earned rewards
• We reserve the right to modify, suspend, or terminate the rewards program with 60 days' notice

Sign-on bonus points are awarded after you meet the specified spending threshold within the promotional period. If your account is closed before the bonus is awarded, you forfeit any pending bonus.

You agree not to use your Hollywood Vault credit card or account for any of the following prohibited purposes:

• Illegal transactions, including purchases of controlled substances, illegal gambling, or money laundering
• Purchasing currency, cryptocurrency, or money orders with the intent to circumvent cash advance fees
• Manufactured spending, including buying prepaid cards or gift cards for the sole purpose of earning rewards
• Sharing your card or account credentials with unauthorized individuals
• Using your card for business expenses on a personal card (or vice versa) in violation of your account type
• Any activity that circumvents or manipulates the rewards program, credit limit, or fee structure
• Reselling goods or services purchased with your card as a business operation

Violation of these prohibitions may result in immediate account closure, forfeiture of rewards, and reporting to consumer reporting agencies.

Zero Liability Protection

You are protected by our Zero Liability Policy: you will not be held responsible for unauthorized charges reported within 60 days of the transaction date. To report unauthorized charges, contact us immediately at 1-800-VAULT-PI.

Service Disclaimers

Our Services are provided "as is" and "as available." We do not warrant that our website, mobile app, or Services will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Liability

Except for our obligations under the Truth in Lending Act and other non-waivable consumer protection laws, our total liability for any claim arising from your use of our Services is limited to the amount of fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

You may close your account at any time by contacting customer service. You are responsible for paying the full outstanding balance, including accrued interest and fees, upon closure.

We may close or suspend your account at any time, with or without cause, including for: inactivity (12 months or more), violation of these Terms, deterioration in your credit profile, fraud suspicion, or regulatory requirements. We will provide notice as required by law.

Any dispute arising from these Terms or your account will be resolved through binding arbitration, except where prohibited by law. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

You and we agree to waive the right to participate in a class action lawsuit or class-wide arbitration. Either party may opt out of this arbitration provision within 30 days of account opening by written notice to our Legal Department.

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles. The federal courts located in Los Angeles County, California, have exclusive jurisdiction over any appeals from arbitration.

We may modify these Terms at any time. Material changes will be provided to you at least 45 days before they take effect, as required by the Truth in Lending Act. Your continued use of your card after the effective date constitutes acceptance of the modified Terms. If you do not agree to the changes, you may close your account under the prior Terms by paying your balance in full.
